Defendant: Chen Jingyuan, male, Han ethnicity, born June 30, 1976, Citizen ID Number 510212197606300330, PhD degree, unemployed, registered residence in Xuhui District, Shanghai, residing at 407 Zhaojiabang Road, Xuhui District, Shanghai.  Criminally detained by the Xishan Branch of the Kunming Public Security Bureau on September 7, 2022, on suspicion of picking quarrels and provoking trouble; arrested by the Xishan Branch of the Kunming Public Security Bureau on October 14, 2022, with the approval of this Procuratorate, on suspicion of picking quarrels and provoking trouble.

This case was investigated by the Xishan Branch of the Kunming Public Security Bureau of Yunnan Province and transferred to this Procuratorate for prosecution on December 16, 2022, with the case of defendant Chen Jingyuan picking quarrels and provoking trouble.  After accepting the case, this Procuratorate informed the defendant on December 16, 2022, of his right to appoint a defense lawyer, interrogated the defendant according to law, listened to the opinions of the defense lawyer, and reviewed all the case materials.

From July 2019 to April 2022, the defendant Chen Jingyuan used circumvention software to use chat tools to spread **false statements** on the information network, **disrupting social order**. The defendant Chen Jingyuan was arrested by the police on September 6, 2022, at 13A02, Building 14, Area 1, Rencheng, Xishan District, Kunming City.

The evidence for determining the above facts is as follows:

1.  Physical evidence; 2. Documentary evidence; 3. The defendant's confession and defense; 4. Expert opinions; 5. Records of investigation, inspection, identification, etc.; 6. Audio-visual materials and electronic data.

This Procuratorate believes that

the defendant Chen Jingyuan disregarded national law, **knowingly** spread and disseminated **false information** on the information network, causing **serious** disorder in public order. His behavior violated Article 293 of the "Criminal Law of the People's Republic of China." The facts of the crime are clear, the evidence is reliable and sufficient, and he should be held criminally responsible for picking quarrels and provoking trouble. According to the provisions of Article 176 of the "Criminal Procedure Law of the People's Republic of China," a public prosecution is initiated, please impose a sentence according to law.
