Severe Harm Social Order
In his self-defense and accusation, Chen Jingyuan systematically refuted the prosecutor’s accusation that his actions “caused serious public disorder,” encompassing three levels of scientific argumentation, legal interpretation, and empirical observation.
First, from a scientific perspective, he introduced the inherent complexity and disorder of social networks, as well as the CAP theorem, to deny the causal relationship between his “reposting behavior” and “disorder.”
Then, he examined specific legal provisions to disprove the so-called “serious disorder” as inconsistent with basic facts.
Finally, from an empirical perspective, after serving his sentence, Chen Jingyuan discovered that all of his reposts, which were allegedly “irrefutable evidence of his crimes,” still existed online, but received no attention, no reposting, no discussion, and had not generated any social response.
